Reading Eagle Company and readingeagle.com strive to offer
visitors to our site a personal Internet experience, and to do
this, we may from time to time ask for or use information such
as your name, e-mail address, street address, telephone
number, or certain demographic information subject to the
terms of this privacy policy. This policy applies to
information collected online and is not applicable to
information collected or used by Reading Eagle Company or
readingeagle.com through other means.
Requests for information.
The nature of the information we might collect and the way in
which we gather and store it depends on the web page that you
are visiting or the services or activities you select on those
pages. For example, you may be asked to provide appropriate
information when you register for access to certain portions
of our site, participate in forums, subscribe to the
newspaper, request an archive reproduction, or use certain
features. No information that identifies you personally will
be gathered unless you are afforded the opportunity to refuse
to provide such information.
Automatic Tracking
While readingeagle.com does log certain tracking information
in ways transparent to visitors, this is not information that
personally identifies any visitor. Examples are recording a
visitor’s Internet service provider or tracking the number of
pages visited. We may use cookie technology to recognize
someone on a subsequent visit. You can choose not to provide
us with such information by setting your browser to refuse
cookies, but that may render you unable to access certain
portions of the site.
What we do with information.
We collect information to enhance your visit and may use it to

content. Information gathered on readingeagle.com will not be

or promotional partners unless you are offered the opportunity

Information that does not personally identify you may be used
to enhance our site and services. For example, we may combine
information about your usage patterns with similar information
from other users to determine which pages are visited most or
what features are most popular. Such information may be shared
with advertisers and business affiliates, but only if it does
not include any information to identify you individually.
Affiliated sites, linked sites and advertisements.
Be aware that third parties, including our advertisers,
affiliates and others whose content may be accessible through
readingeagle.com may have their own privacy and data
collection policies and practices. During your visit to our
site you may link to or view certain content that is created
or hosted by a third party. You should check the applicable
privacy policies of those parties when providing information
to them.
Non-requested Information
If you voluntarily disclose information on message boards or
in chat areas, that information may be viewed publicly and can
be collected and used by third parties without our knowledge
and outside the control of readingeagle.com or this policy.
Children.
Reading Eagle Company and readingeagle.com do not knowingly
collect personal information from or about children under 15
except as permitted by law. If we discover we have received
any information from a child under 15 in violation of this
policy, we will delete that information. If you believe
readingeagle.com has any information from or about anyone

Implied acceptance and changes to this policy.
Continued use of readingeagle.com constitutes acceptance of
this policy and any changes that may from time to time be
posted. Reading Eagle Company reserves the right to change
this policy at any time, but information collected prior to
the posting of any change will be used only according to rules
or laws in effect at the time the information was collected.
Compliance with law.
It is the intent of Reading Eagle Company that this privacy
policy and operations of readingeagle.com shall comply with
applicable laws of the Commonwealth of Pennsylvania and the
United States of America. This statement and policies herein
are not intended to and do not create any contractual or other
legal rights in or on behalf of any party. No other portion of
this policy withstanding, we may disclose personal information
if we are required to do so by law or we in good faith believe
that such action is necessary to comply with the law; protect
our rights and property; protect against misuse or
unauthorized use of readineagle.com; or protect the safety or
property of our users or the public.

THIS AGREEMENT is made and entered into by and between Reading
Eagle Company and You.
License. Reading Eagle Company hereby grants You a
non-exclusive, non-transferable license to access Reading
Eagle Company Archives™ electronic information Archives (the
“Archive”) and to download, print-out and use the information
provided through the Archives solely for your own personal or
internal research purposes. You shall not publish, distribute,
sell, retransmit, broadcast or otherwise reproduce the
Archives and the information provided through the Archives in
any way. The Archives and all information provided through the
Archives is and shall remain the sole and exclusive property
of Reading Eagle Company or its third party information
suppliers. You acquire no proprietary or ownership interest in
the Archives or any information provided through the Archives.
All copyright notices or other proprietary rights notices
contained in or associated with the Archives shall be
preserved by You.
Charges. The price for access to the Archives for a period of
twenty-four (24) hours is eight dollars and ninety-five cents
($8.95) payable in advance by credit card (“Archives
Charges”). You shall pay all applicable taxes related to the
Archives. Reading Eagle Company shall bill Archives Charges to
Your credit card that has been pre-approved, pre-authorized or
otherwise validated by Reading Eagle Company. You are
responsible for and shall pay for all costs and expenses
related to accessing the Archives, including but not limited
to, all equipment and software necessary to access the
Archives, Internet/World Wide Web access and all
telecommunications charges related to accessing the Archives.
Term. By using the Archives, You expressly agree to the terms
and conditions of this Agreement. You may use the Archives for
a period of twenty-four (24) hours from the time of activation
of Your password or identification code.
Use/Information. Reading Eagle Company provides the Archives
to You on an “as is” basis. Use of the Archives and any
information obtained through the Archives is at Your sole
risk. Reading Eagle Company disclaims any responsibility for
the accuracy, quality or content of the Archives and any
information obtained through the Archives. The Archives does
not contain all of the information or materials published in
the publications provided the Archives. Information and
materials may be withdrawn from the Archives, and the Archives
may otherwise be changed at any time by Reading Eagle Company
without notice to You.
Restrictions. You shall use the Archives only for lawful
purposes, and You shall comply with all applicable federal,
state and local laws, rules and regulations and the policies
and guidelines of Reading Eagle Company and any common carrier
associated with the Archives. You shall not use the Archives
in any way which does not conform to the public interest or
which may violate the rights of Reading Eagle Company or
others, including but not limited to copyright infringement,
or which may constitute libel or slander. You shall use
reasonable efforts to promote efficient use of the Archives,
and shall not interfere with others or disrupt the Archives.
You shall not provide or permit connectivity which would allow
the use of or access to the Archives by another entity or
party.
Identification. You shall use the Archives password(s) or
identification code(s) specified by Reading Eagle Company.
Each individual user may be assigned a unique password or
identification code and such password or identification code
shall not be transferred or shared. You are responsible for
the confidentiality and the use of Your password(s) and
identification code(s), including the payment of all Archives
Charges charged to Your account by anyone using Your
password(s) or identification code(s). You shall immediately
notify Reading Eagle Company in the event a password or
identification code is lost or stolen. You shall remain
responsible for all Archives Charges charged to Your account
until the above written notice is received by Reading Eagle
Company.
Indemnification. You shall indemnify Reading Eagle Company
against all claims arising out of this Agreement, the Archives
and Your use of the Archives or the information provided
through the Archives, including but not limited to claims that
Reading Eagle Company or the Archives or the information
provided through the Archives violates any copyright, patent
or other personal or proprietary right or that any information
related to the Archives is defamatory, obscene, inaccurate or
otherwise in error.
No Warranties. Reading Eagle Company MAKES NO WARRANTIES OF
ANY KIND WITH RESPECT TO THE Archives WHETHER EXPRESSED OR
IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR
CONFORMITY TO ANY REPRESENTATION OR DESCRIPTION. Reading Eagle
Company SHALL NOT BE RESPONSIBLE FOR THE ACCURACY, QUALITY OR
CONTENT OF ANY INFORMATION OR TRANSMISSION SENT OR RECEIVED
THROUGH THE Archives.
Outages. In no event shall Reading Eagle Company have any
liability for any mistakes, omissions, interruptions, delays,
errors or defects occurring in the course of furnishing the
Archives.
Limitation of Liability. In no event shall Reading Eagle
Company be liable for any damages or any claim of any kind
arising out of this Agreement, the provision of the Archives,
or the information provided through the Archives. In no event
shall Reading Eagle Company be liable for special, incidental,
consequential or punitive damages, including but not limited
to loss of revenue or profit, loss of use of any property,
cost of substitute performance, equipment or Archives, cost of
capital, downtime costs and loss of data. Your sole remedy for
any claim arising out of this Agreement shall be the
termination of this Agreement. Reading Eagle Company shall not
be liable, either directly or indirectly, for any claims
arising out of the actions or inaction of the provider of any
information or Archives accessed through the Archives.
Statutory Provisions. Some jurisdictions do not allow
excluding or limiting implied warranties or limiting liability
for incidental or consequential damages. As a result, the
warranty and liability exclusions or limitations contained in
this Agreement may not apply to You if prohibited by the laws
of Your jurisdiction.
Miscellaneous. No failure or delay by any party in exercising
any right hereof shall operate as a waiver of such right or
that of a future occasion. In the event that any term or
provision of this Agreement shall be deemed or rendered void
or unenforceable, the remainder of this Agreement shall remain
in full force and effect and such term or provision shall be
deemed stricken. This Agreement shall be deemed to have been
executed and delivered in the State of Pennsylvania and it
shall be governed by and construed in accordance with the laws
of the State of Pennsylvania, not including those relating to
choice of laws. Any actions based upon or relating to this
Agreement shall be brought in the federal or state courts in
Pennsylvania. This Agreement and all attachments hereto set
forth the entire agreement and understanding between the
parties and supersede all prior oral and written, and
contemporaneous oral, agreements and understandings relating
to the subject matter hereof. No representation, promise,
inducement or statement of intention not expressly set forth
herein has been made by either party. |
